When a consultant claims unfair dismissal
Berg Legal was called in by a company which ran 15 care homes for the elderly and employed around 1,000 staff. The company had been using a self-employed consultant, however following termination of her agreement, she alleged she had been an employee and sought to bring a claim for unfair dismissal.
Berg Legal was successful in defeating the claim and obtaining an award for costs. We also provided on-going advice and support to the organisation and its management team in employment law and HR best practice to help prevent similar situations arising in the future.
Six-figure pay-out for director
A director who had been engaged by a major retailer for approximately 30 years was sacked following a series of allegations concerning his business practices and his conduct whilst on buying trips. The director was also suffering from ill health. Berg Legal successfully mediated with the company and secured a six-figure severance package for the director.
