When a consultant claims unfair dismissal
Berg Legal was called in by a company which ran 15 care homes for the elderly and employed around 1,000 staff. The company had been using a self-employed consultant, however following termination of her agreement, she alleged she had been an employee and sought to bring a claim for unfair dismissal.
Berg was successful in defeating the claim and obtaining an award for costs. We also provided on-going advice and support to the organisation and its management team in employment law and HR best practice to help prevent similar situations arising in the future.
