The Defendant companies tried to frustrate Trident’s legitimate claim by seeking security for costs against Trident. They were successful at first instance but on berg’s advice the client appealed to the Court of Appeal and a landmark ruling was obtained in the Court of Appeal in favour of Trident; Trident v MSC is regularly cited and relied on now in security for cost applications.
This victory enabled the client to pursue the claim and ultimately negotiate a favourable settlement in favour of the Claimant.
